Board of Director's -- NOVEMBER -- Regular Meeting
CALL TO ORDER: Wednesday, November 14, 2001 –
President R. Reinhart convened the meeting to order at 17:30 hours.
ROLL CALL: R. Reinhart, President; J.K. Muller,
Vice-President; J. Huss, Secretary; D. Hashin, Treasurer; A. Preece,
Sergeant-at-Arms/ Director; B. Reed, Director; R. Frahm, Director; S.
Ekstedt, Director; G. Coerper, Director.
OTHER MEMBERS PRESENT: None.
GUESTS: M. Reid.
MINUTES: Motion by G. Coerper and A. Preece to
accept the minutes as written for October 10, 2001 meeting, with all
concurring.
In later discussion R. Frahm asked that the minutes be
corrected to reflect previous approval of payment regarding the "PreShift
– PostShift" lawsuit for $2,500.00, payment made on 10-10-01. Matter was
handled during October Regular Meeting Executive Session.
TREASURER REPORT: D. Hashin distributed the
November Treasurer’s Report and gave an overview of the POA’s accounts and
balance(s). Stated that the City now views the POA as a "vendor" and are
making the POA’s deposit via, direct deposit a week after the payroll
payment date.
D. Hashin said that all bills received fell within the
budgeted limits. Credit card statement was passed and initialed by the
directors. Motion by G. Coerper and J.K. Muller to accept the Treasurer’s
Report and credit card statement, with all concurring.
Discussion also held on the recent letter(s) to
Associate, and non-Associate (SRC only) Members. R. Reinhart said that he
spoke with PMA President C. Thomas, and he was agreeable to handle the
payroll deductions for those members who needed it (specifically for SRC),
but said no one had approached their association regarding the matter
ever.
OLD BUSINESS
PARKING CONTROL OFFICERS: M. Reid drafted a
petition for the PCO’s to join the POA, and it was prepared, signed and
submitted to the City, pending action. The Personnel Commission Meeting
was cancelled for November, so the matter will need to be addressed at the
December Meeting.
LAWSUITS: R. Reinhart said that the ‘Per Diem’
Lawsuit is still pending a settlement and our attorney has submitted a
settlement offer to the City, but they have not signed it yet. Plaintiff
checks will be held until the settlement is signed.
CHRISTMAS PARTY: Discussion held on funds needed to
be budgeted for the Christmas Party and R. Frahm said that about $9,000.00
would be required, with ticket sales, which could generate about
$4,000.00. Actual cost of the ticket is $52.12 – dinner cost $43.12
per/person; two beverage costs $4.50 per/ drink. DJ entertainment is
$1,200.00. Motion by R. Frahm and B. Reed to approve required funds, with
all concurring.
Hosted hospitality suite, plus special gifts that
members would be able to place raffle tickets in for selection and
purchase addition tickets. (Gifts: Weekend get-away in Santa Barbara; 27"
TV; DVD system; auto detailing equipment; tools; children entertainment
basket)
Tickets are now available for the POA Christmas Party.
Ticket costs are $20.00 per ticket (including Associate Members), and
non-members tickets would be $50.00, which also includes 2 beverage
tickets.
POA SCHOLARSHIP: Scholarship interview(s) will be
held on November 17, 2001. Interviewing members of the Board of
Directors will be: A. Preece, S. Ekstedt, and D. Hashin.
NEW BUSINESS
HONORARY MEMBERS MIXER: J. Huss said that he had
contacted the Elks Lodge as a possible site to host the evening mixer for
POA Honorary Members Mixer night. He said that these members are an
important group of supporters and that it was time to have a night to have
POA members meet and mix with them on a one-on-one basis. Discussion held
as to date selection and what will be provided on that night… S. Ekstedt
assisting.
COP ARTWORK: J. Huss showed an illustration of
artwork revised with the POA’s logo modified with the child holding a
flag, by a local artist - Phillip Miller 714-894-0371 of Blown Away,
glass etching. He said that the POA could incorporate this artwork in
with certificates given out or just allow for its sale independently.
Discussion held, no action taken.
PORAC CONFERENCE: R. Reinhart said that he would be
attending the PORAC Conference in Reno, NV leaving tomorrow. He also said
that on Monday, November 19, 2001 the Orange County Chapter would be
hosting candidate interviews for the position of District Attorney.
Members wishing to attend and observe are welcome.
STUFFED ANIMALS: R. Frahm asked for a $150.00
donation to assist the family of Christina Owens, who wants to donate
stuffed animals in her memory to be placed in the police cars to be
distributed to children. Discussion held and that the Department already
has a stuffed animal program. The Department would have to authorize the
placement of these animals in the police cars. No action taken.
LABOR RELATIONS INFORMATION SYSTEM:
www.LRIS.com Members of the Executive Board will
be attending a seminar titled "How To Run A Police/ Fire Union" November
28-30, 2001 in Las Vegas, NV. This seminar will provide updated
information on very useful relative topics to the POA.
CORRESPONDENCE
LETTER:
R. Reinhart asked for action on a
letter tabled from J. Page for financial assistance with hockey
league fees, due to several team members’ failure to commit.
Discussion held. Motion by A. Preece and G. Coerper not to pay for
these fees, with all concurring.
COMMITTEES
INSURANCE & BENEFITS COMMITTEE:
(November 11, 2001)
R. Reinhart said that the open enrollment period for
members changing health care plans in by November 30th, which
concerns specifically those with PacifiCare because that plan will end and
the only HMO provided by the City will be HealthNet.
The City also said that health coverage is not paid in
advance, and terminates at the end of the month that an employee separates
from the City.
D. Hashin said that there was a lengthy discussion was
held on how the City will take the "snap shot" to determine rates for a
year, especially regarding the POA’s contract for employees covering costs
above 10% in 2003. M. Reid said that the POA needs to communicate with the
City in advance of the "snap shot" to get the City’s rate of projection
timely.
LABOR MANAGEMENT RELATIONS COMMITTEE: (November 14,
2001)
R. Reinhart gave an overview on the following topics of
discussion at the last LMRC Meeting held earlier today.
Health Care: Clay Martin gave a memo with
topics of concern regarding City Health Care issues, however there
was still a question as to out-of-state coverage for retirees, which
is also being addressed by the I&B Committee.
Holiday Pay: Specifically addressing
Veteran’s Day, which was the first and on non-date specific holiday
to fall within the guidelines as prescribed by the MOU. The POA’s
position was to follow the language of the MOU, regardless of past
practice. It was pointed out that the language was deleted from
PMA’s contract, but not ours.
ARTICLE XII – LEAVE BENEFITS
B. Holidays – The following are recognized legal holidays
under this MOU:
Veteran’s Day (November 11)
Holidays which fall on Sunday shall be observed the
following Monday, and those falling on Saturday shall be
observed the preceding Friday.
Jon Arnold spoke on behalf of the Department
stating that it didn’t matter with him as to which day was paid for
either Sunday, Veteran’s Day, or Monday, but that he disagreed with
our interpretation of the language. Bill Osness felt that it was a
grievance issue and not a "contract breach grievance," therefore not
subject to litigation as a contract violation, but if the POA felt
they needed to sue us (city) then they could. Clay Martin attempted to
seek a remedy of the situation, but had not prior to the end of the
meeting.
Discussion held on how best to address this. Motion
by A. Preece and G. Coerper to have M. Reid draft a letter seeking a
side letter’ agreement to come in line with the practice and clean up
the language, with all concurring.
Correspondence: M. Reid had asked about whom
the City Council had designated as the official person to receive
correspondence from the POA, due to a lack of response on several
issues from the City. Clay Martin said that correspondence should be
directed to Bill Workman, Assistant City Administrator, with copies
to Bill Osness, and himself. Clay Martin agreed to respond with that
in writing.
CHARITY COMMITTEE
Honorary Members: A Mixer to say ‘thank you’
to the Honorary Members of the POA will be held on Thursday, January
31, 2002 at the Huntington Beach Elks Lodge. J. Huss and S. Ekstedt
are coordinating the event. Honorary Members will be formally
invited and POA members are encouraged to attend as well.
OTHER BUSINESS
STAFF MEETING MINUTES:
Reviewed the Staff Meeting
Minutes of October 31, 2001.
POA/ SENIOR STAFF MEETINGS – These meetings are
held on the last Thursday of the month at 1500 hours. It was decided
that a formal agenda should be produced one week in advance. Senior
Staff and POA should submit their agenda items to Gloria at least a
week prior to the meeting. If there are no items to discuss, the
meeting will be cancelled until the next month.
Discussion held if these "informal" meetings were now
to become more "formal" with an established agenda, would minutes recorded
of the meetings for posting, etc.
